These Terms of Service ("Terms") govern your access to and use of BentoPing, a WhatsApp-based staff-scheduling service for restaurants (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and have the authority to enter into these Terms on behalf of the restaurant/business you register. By using the Service you represent that the information you provide is accurate and that you are authorised to act for that business.
BentoPing lets a restaurant build staff rosters, publish shifts to staff over WhatsApp, and manage attendance, leave, and shift cover. Features and plans may change over time. The Service assists with scheduling and record-keeping; it does not calculate wages, taxes, or statutory payroll amounts and is not a payroll, accounting, legal, or HR advisory service (see clause 8).
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use. We are not liable for loss arising from your failure to safeguard your credentials.
You agree not to: use the Service for any unlawful purpose; send unsolicited, spam, or harassing messages to staff; upload data you have no right to use; attempt to breach or probe the Service's security; interfere with or overload the Service; resell or provide the Service to third parties without our permission; or use the Service in a way that could cause our WhatsApp/messaging accounts to be restricted or suspended.
The Service relies on third-party providers, including WhatsApp/Meta and providers of messaging, payment, authentication, and cloud-hosting services. Your use of features involving these providers may also be subject to their terms. We are not responsible for the acts, omissions, availability, pricing changes, or decisions of these third parties (for example, WhatsApp/Meta restricting or suspending a messaging number, or a payment provider's processing). Message delivery over WhatsApp is not guaranteed and may be affected by factors outside our control.
BentoPing provides scheduling and attendance records that you may use as inputs to payroll and compliance. It does not compute wages, overtime pay, PF/ESI/TDS, or any statutory amounts, and does not advise on labour law, working-hours limits, leave entitlements, or minor-employment rules. You are solely responsible for complying with all applicable labour, employment, tax, and other laws. Any figures shown (e.g., estimated labour cost, hours, overtime against a threshold you set) are for your convenience only and are not a statement of legal entitlement or liability.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that messages will always be delivered on time or at all.
To the maximum extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business, arising out of or related to the Service; and (b) our total aggregate liability for all claims relating to the Service will not exceed the total amount you paid to us for the Service in the three (3) months immediately preceding the event giving rise to the claim (or ₹1,000 if you have paid nothing). Some jurisdictions do not allow certain limitations; where that applies, our liability is limited to the smallest extent permitted by law.
BentoPing, the BentoPing® name and logo, and the Service (including all software, design, and content we provide) are owned by Kiratha Enterprises and protected by law. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law. The data you enter remains yours; you grant us the limited right to process it to provide the Service.
We may suspend or terminate your access if you breach these Terms, fail to pay, misuse the Service, or where necessary to protect the Service, other users, or our messaging accounts. You may stop using the Service at any time. On termination, your right to use the Service ends; provisions that by their nature should survive (including clauses 6, 8, 9, 10, 11, and 13) will survive.
These Terms are governed by the laws of India. Subject to any applicable law, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date. Your continued use of the Service after changes take effect constitutes acceptance.
